Port\u00e9e<\/strong><\/h3><p>Ces conditions s'appliquent \u00e0 toutes les ventes de <strong>produits num\u00e9riques<\/strong>, <strong>cours en ligne<\/strong>, <strong>formation en personne<\/strong>, et <strong>services professionnels<\/strong> offerts par Guenix Digital, y compris :<\/p><ul><li>Conseil en communication digitale (Impression, SEO, GEO, AEO, marketing digital)<\/li><li>Conseil en entreprise (strat\u00e9gie num\u00e9rique, marketing, communication et services connexes)<\/li><li>Formation (strat\u00e9gies num\u00e9riques, marketing de donn\u00e9es, communication et services associ\u00e9s)<\/li><li>Ventes en ligne de produits num\u00e9riques relacionados au marketing, \u00e0 la communication et aux donn\u00e9es<\/li><li>Gestion de projet (projets num\u00e9riques et de donn\u00e9es)<\/li><li>Conseil strat\u00e9gique (strat\u00e9gie num\u00e9rique, marketing de donn\u00e9es, communication et marketing)<\/li><\/ul><p>Nous servons des consommateurs B2C et des entreprises B2B en France, dans l'UE et \u00e0 l'international. Toute commande, achat en ligne ou devis sign\u00e9 vaut acceptation pleine et enti\u00e8re des pr\u00e9sentes Conditions.<\/p><hr \/><h3><strong>2. Produits et Services<\/strong><\/h3><p>Guenix Digital propose :<br \/><strong>2.1 Produits num\u00e9riques :<\/strong> livres \u00e9lectroniques, guides, kits d'outils, packs d'invites, mod\u00e8les et ressources de donn\u00e9es livr\u00e9s \u00e9lectroniquement.<br \/><strong>2.2 Formation en ligne :<\/strong> modules d'apprentissage \u00e0 votre rythme via LearnDash.<br \/><strong>2.3 Formation sur site :<\/strong> interventions corporatives ou \u00e9ducatives (expertise technique\/p\u00e9dagogique ; non certifi\u00e9 par l'\u00c9tat ex: Qualiopi).<br \/><strong>2.4 Conseil &amp; Strat\u00e9gie :<\/strong> strat\u00e9gie num\u00e9rique, marketing, communication, marketing de donn\u00e9es, audits SEO\/AEO\/GEO, et gestion de projets num\u00e9riques.<br \/><strong>2.5 Fichiers d'impression num\u00e9riques :<\/strong> livraison des fichiers de conception uniquement ; l'impression et la production physique rel\u00e8vent de la responsabilit\u00e9 du Client.<\/p><hr \/><h3><strong>3. Commande et Paiement<\/strong><\/h3><p><strong>3.1 Ventes num\u00e9riques :<\/strong> trait\u00e9 via SureCart ; pay\u00e9 en totalit\u00e9 via Stripe avant l'acc\u00e8s.<br \/><strong>3.2 Devis de service :<\/strong> signature manuscrite requise ; un acompte de 30 \u00e0 50 %% peut \u00eatre demand\u00e9 avant le d\u00e9but des travaux.<br \/><strong>3.3 Gestion des annonces :<\/strong> Le client donne acc\u00e8s \u00e0 son \u201c Partenaire \u201d pour g\u00e9rer ses comptes de gestionnaire d'entreprise (Google, Meta, etc.). Les budgets publicitaires sont pay\u00e9s directement par le client aux plateformes.<\/p><hr \/><h3><strong>4. Retenues SEO\/AEO\/GEO<\/strong><\/h3><p><strong>4.1 Engagement Minimum :<\/strong> 3 mois.<br \/><strong>4.2 Renouvellement :<\/strong> renouvellement automatique de mois en mois apr\u00e8s la p\u00e9riode initiale.<br \/><strong>4.3 Annulation :<\/strong> autoris\u00e9 apr\u00e8s 3 mois avec un pr\u00e9avis \u00e9crit d'un (1) mois par courrier \u00e9lectronique ; tout mois entam\u00e9 est d\u00fb en totalit\u00e9.<\/p><hr \/><h3><strong>5. Livraison num\u00e9rique et droit de r\u00e9tractation (B2C)<\/strong><\/h3><p><strong>5.1 Acc\u00e8s imm\u00e9diat :<\/strong> l'acc\u00e8s aux produits et cours num\u00e9riques est accord\u00e9 apr\u00e8s paiement.<br \/><strong>5.2 Pas de droit de r\u00e9tractation \u2013 contenu num\u00e9rique :<\/strong> Conform\u00e9ment \u00e0 l'article L221-28 du Code de la consommation fran\u00e7ais, le droit de r\u00e9tractation ne s'applique pas aux contenus num\u00e9riques fournis imm\u00e9diatement ; en validant son achat, le Client renonce express\u00e9ment \u00e0 ce droit.<br \/><strong>5.3 Prestation de services :<\/strong> pour les consommateurs, un d\u00e9lai de r\u00e9tractation de 14 jours peut s'appliquer sauf si la prestation commence imm\u00e9diatement. Si le Client demande une prestation avant l'expiration, il reconna\u00eet perdre son droit de r\u00e9tractation une fois le service int\u00e9gralement ex\u00e9cut\u00e9. Scope<\\\/strong><\\\/h3><p>These Terms apply to all sales of <strong>digital products<\\\/strong>, <strong>online courses<\\\/strong>, <strong>in-person training<\\\/strong>, and <strong>professional services<\\\/strong> offered by Guenix Digital, including:<\\\/p><ul><li>Digital communication consulting (Print, SEO, GEO, AEO, digital marketing)<\\\/li><li>Business consulting (digital strategy, marketing, communication, and related services)<\\\/li><li>Training (digital strategies, data marketing, communication, and associated services)<\\\/li><li>Online sales of digital products related to marketing, communication, and data<\\\/li><li>Project management (digital and data projects)<\\\/li><li>Strategic consulting (digital strategy, data marketing, communication, and marketing)<\\\/li><\\\/ul><p>We serve B2C consumers and B2B businesses in France, the EU, and internationally. Any order, online purchase, or signed quotation constitutes full acceptance of these Terms.<\\\/p><hr \\\/><h3><strong>2. Products &amp; Services<\\\/strong><\\\/h3><p>Guenix Digital provides:<br \\\/><strong>2.1 Digital Products:<\\\/strong> ebooks, guides, toolkits, prompt packs, templates, and data resources delivered electronically.<br \\\/><strong>2.2 Online Training:<\\\/strong> self-paced modules via LearnDash.<br \\\/><strong>2.3 On-site Training:<\\\/strong> corporate or educational interventions (technical\\\/pedagogical expertise; not state-certified e.g., Qualiopi).<br \\\/><strong>2.4 Consulting &amp; Strategy:<\\\/strong> digital strategy, marketing, communication, data marketing, SEO\\\/AEO\\\/GEO audits, and digital project management.<br \\\/><strong>2.5 Digital Print Files:<\\\/strong> delivery of design files only; printing and physical production are the Customer\\u2019s responsibility.<\\\/p><hr \\\/><h3><strong>3. Ordering &amp; Payment<\\\/strong><\\\/h3><p><strong>3.1 Digital Sales:<\\\/strong> processed via SureCart; paid in full via Stripe before access.<br \\\/><strong>3.2 Service Quotations:<\\\/strong> written signature required; 30\\u201350% deposit may be requested before work begins.<br \\\/><strong>3.3 Ads Management:<\\\/strong> Customer provides \\u201cPartner\\u201d access to their Business Manager accounts (Google, Meta, etc.). Ad budgets are paid directly by the Customer to the platforms.<\\\/p><hr \\\/><h3><strong>4. SEO\\\/AEO\\\/GEO Retainers<\\\/strong><\\\/h3><p><strong>4.1 Minimum Commitment:<\\\/strong> 3 months.<br \\\/><strong>4.2 Renewal:<\\\/strong> automatic month-to-month renewal after the initial term.<br \\\/><strong>4.3 Cancellation:<\\\/strong> permitted after 3 months with one (1) month prior written notice via email; any month started is due in full.<\\\/p><hr \\\/><h3><strong>5. Digital Delivery &amp; Right of Withdrawal (B2C)<\\\/strong><\\\/h3><p><strong>5.1 Immediate Access:<\\\/strong> access to digital products and courses is granted upon payment.<br \\\/><strong>5.2 No Withdrawal Right \\u2013 digital content:<\\\/strong> under Article L221-28 of the French Consumer Code, the withdrawal right does not apply to digital content supplied immediately; by completing the purchase, the Customer expressly waives this right.<br \\\/><strong>5.3 Service Provision:<\\\/strong> for consumers, a 14-day withdrawal period may apply unless performance begins immediately. If the Customer requests performance before expiry, they acknowledge losing the withdrawal right once the service is fully performed. B2B Customers have no withdrawal right.<\\\/p><hr \\\/><h3><strong>6. Refund Policy<\\\/strong><\\\/h3><p><strong>Digital Products &amp; Online Courses:<\\\/strong> Due to the nature of digital content, all sales are final once access is granted. By purchasing, you acknowledge that you gain immediate access to the content and expressly waive your right of withdrawal.<\\\/p><p><strong>Service Subscriptions (SEO\\\/Marketing):<\\\/strong> Payments for the current month are non-refundable. If you cancel your subscription, the service will continue until the end of the paid period, and no further charges will be made.<\\\/p><p><strong>On-site Training &amp; Consulting:<\\\/strong><\\\/p><ul><li>Cancellations made by the client more than <strong>14 days<\\\/strong> before the scheduled date may be eligible for a <strong>full refund<\\\/strong>.<\\\/li><li>Cancellations made within <strong>7 to 14 days<\\\/strong> are subject to a <strong>50% cancellation fee<\\\/strong>.<\\\/li><li>No refunds are provided for cancellations made <strong>less than 7 days<\\\/strong> before the service date.<\\\/li><\\\/ul><p>If you believe you are entitled to a refund under applicable consumer protection laws, please contact us at <strong>contact@guenix.digital<\\\/strong>.<\\\/p><hr \\\/><h3><strong>7. International Orders (Non-EU)<\\\/strong><\\\/h3><p><strong>7.1 Taxes:<\\\/strong> services to non-EU Customers are invoiced without French VAT; the Customer is responsible for local taxes, customs duties, or withholdings.<br \\\/><strong>7.2 Compliance:<\\\/strong> the Customer ensures purchased products\\\/services comply with local regulations.<\\\/p><hr \\\/><h3><strong>8. Customer Obligations<\\\/strong><\\\/h3><p>Customer must: (i) provide accurate information; (ii) hold required authorizations (ad accounts, technical access); (iii) comply with applicable laws (including GDPR for any data shared with Guenix Digital).<\\\/p><hr \\\/><h3><strong>9. Intellectual Property &amp; Licensing<\\\/strong><\\\/h3><p><strong>9.1 Digital Products &amp; Training:<\\\/strong> non-exclusive, non-transferable license for personal or internal business use. Resale, redistribution, unauthorized sharing are prohibited.<br \\\/><strong>9.2 Custom Deliverables:<\\\/strong> unless otherwise agreed in the quotation\\\/contract, an internal-use license is granted; methodologies, know-how, templates, and libraries remain Guenix Digital\\u2019s property.<\\\/p><hr \\\/><h3><strong>10. Confidentiality<\\\/strong><\\\/h3><p>Both Parties shall keep confidential non-public information exchanged during the engagement, during and for 5 years after termination.<\\\/p><hr \\\/><h3><strong>11. Data Protection<\\\/strong><\\\/h3><p><strong>11.1 Roles:<\\\/strong> Guenix Digital acts as a data controller for its own activities (website, marketing, billing) and as a processor when processing data on the Customer\\u2019s behalf.<br \\\/>**11.2 The Customer remains responsible for the lawfulness of data shared and instructions provided.<\\\/p><hr \\\/><h3><strong>12. Warranties &amp; Liability<\\\/strong><\\\/h3><p><strong>12.1 Best-efforts:<\\\/strong> Guenix Digital provides expertise and reasonable efforts; no guarantee of specific results (e.g., rankings, ROI) due to third-party algorithms and market conditions.<br \\\/><strong>12.2 Limitation:<\\\/strong> total liability is limited to fees paid by the Customer during the preceding 12 months.
